‘Online buying and selling contract’ is intended as a distance contract; that is, the legal shop offering moveable goods and/or services formalised between a supplier, Grafiche Tassotti s.r.l., and a customer in the context of a system of distance sale organised by the supplier who uses the distance communication technology denominated ‘Internet’. ‘Client’ is intended as the physical person who buys goods and services for a purpose not directly relating to their professional activity. The conditions of sale, which will remain in effect until they are altered by the supplier, are shown below. Any alterations to the conditions of sale will be effective from the time they are published on the GRAFICHE TASSOTTI s.r.l. website. 

It is necessary to be a legal adult and be accessible by telephone to make an order.

An order can be made by filling in your personal account.

When an order is sent this represents a proposal to buy products chosen on the basis of the current terms and conditions. GRAFICHE TASSOTTI s.r.l. will be free to accept such a proposal or not.
In any case we will advise of acceptance by the issue of an order confirmation that will be sent via email with effect from the time it is sent. If the order should not be accepted, we will contact you by email or telephone. 

The company is obliged to deliver the goods to the consumer without undue delay and at the latest within 30 days from the date of conclusion of the contract.
GRAFICHE TASSOTTI s.r.l. will do everything possible to supply the products indicated in the order confirmation unless prevented by act of God. In this case we will contact you to inform you and possibly to propose alternative products. If you should not wish to accept our alternative proposals, we will cancel your order for the goods that we are unable to supply.



RETAIL PRICES
All sale prices for the products displayed and indicated on the website www.tassotti.it constitute an offer to the public in accordance with the Italian law art. 1336 Code and included VAT at 22%, a percentage currently in force in Italy.

Tax on distance selling delivered to a private customer located in a EU Member State

To a private customer
From July the 1st, 2021 with the new OSS regulation, distance sales made in the EU to private consumers are considered relevant for VAT purposes of the goods delivered to an EU Member State.

To a recipient holding a VAT identification number
These are intra-EU sales (VAT not included as per art. 41 del DL 331/93), if the following conditions are met:
• the goods are transported or shipped by or on behalf of the supplier to an EU Member State.
• the recipient is registered in the Electronic Vat information exchange system (VIES)

*The site checks the validity of VAT at VIES during the purchase. In case of an invalid VAT number, we suggest registering your VAT number in the VIES, or to proceed with the purchase as a private person without a VAT number (no company).

Tax on distance selling delivered to a private customer not located in an EU Member State
For all sales of goods delivered in non-EU countries, VAT will not be applied in the sale (VAT not included as per art. 8 DPR 633/1972 Italian VAT law) Any taxes, excise duties and customs costs are not included in the shipping costs.



COST OF DELIVERY

The cost of delivery is duly shown in the following pages, which we ask you to read before confirming your purchase; in the case of delivery abroad, you will be responsible for any supplementary costs relating to tariffs or taxes provided for by the laws in force in the country of destination.



PURCHASES AND PAYMENTS
The purchasing contract is completed by exact compilation and agreement to the purchase as demonstrated by the consent given online.

You can pay for the goods ordered using the methods of payment indicated online at the time of purchase.
GRAFICHE TASSOTTI s.r.l. is not responsible for any fraudulent or illicit use that may be made by others of credit cards, cheques or other means of payment at the time of payment for the goods purchased.



DELIVERY

GRAFICHE TASSOTTI s.r.l. will arrange to deliver the products selected and ordered by the methods described above, by means of trusted courier and/or shipper. If you are absent at the time of delivery, notice will be left and you will have to personally contact the courier or shipper as soon as possible to arrange the time and method of delivery. You will be responsible for any additional costs due to delayed delivery.

It is possible to buy the products shown in the electronic catalogue in the quantities available in the warehouse. If an order should exceed the quantity available in the warehouse, GRAFICHE TASSOTTI s.r.l. will advise the buyer as to whether or not that product will be available in future and the expected time of its supply.

GRAFICHE TASSOTTI s.r.l. does not assume any responsibility for disservice due to act of God, such as accident, explosion, fire, strike and/or lock-out, earthquake, flood or other similar event that could entirely or partly impede the order being fulfilled in the times agreed in the contract.
The purchaser agrees, once the online purchasing procedure has been completed, to print and retain these general conditions, which he will have read and accepted in order to fully satisfy the conditions established by the Consumer Code – legislative decree. n. 206/2005.
It is strictly forbidden to insert false and/or fictitious information in the registration procedure necessary to activate the process for fulfilling this contract and the relative further communication; personal details and email address must be the buyer’s own exclusive personal data and not be invented or those of third persons.

By filling in the relative space on this site you authorise GRAFICHE TASSOTTI s.r.l. to use your personal credit card or other card issued to replace this, and to debit your account in favour of GRAFICHE TASSOTTI s.r.l. with the total sum shown as the cost of the online purchase.

INFORMATION ON THE PROCESSING OF PERSONAL DATA
The personal data provided will be processed by Grafiche Tassotti s.r.l. Stamperia in Bassano di Giorgio Tassotti & figli, with registered office in Bassano del Grappa, as Data Controller pursuant to EU Regulation no. 2016/679 (hereinafter, "GDPR").
1. Purpose of data processing. The data you provide are those required by law and / or necessary to achieve the purposes of conclusion and execution of the contract, internal administrative and accounting purposes, and with prior consent for commercial and marketing purposes.
2. Methods of data processing and their conservation. In relation to the aforementioned purposes, personal data are processed using paper-based and IT tools, so as to guarantee the security and confidentiality of the data in compliance with current regulations. The data will be kept for the entire duration of the contractual relationship, for the fulfillment of the law (10 years) as well as for management needs and commercial and marketing purposes.
3. Obligation or optional nature of data provision. The provision of data is optional but any refusal to provide such data could result in the non-continuation of the contractual relationship.
4. Communication and knowledge of data. The personal data you provide may be disclosed to competent authorities for legal obligations or to individuals to fulfill contractual obligations, or consultants (both natural and legal persons) to whom Grafiche Tassotti should entrust tasks for the performance of certain activities related to the operation of the website. In particular, they may be communicated in Italy and abroad to our network of agents, factoring companies, credit institutions, debt collection companies, credit insurance companies, commercial information companies, professionals, subcontractors, companies operating in the transport and logistics sectors. The subjects indicated above, if necessary, will be appointed Data Processor. Your data may also be known by our employees, specifically authorized to process such data for the pursuit of the aforementioned purposes. Grafiche Tassotti S.r.l. adopts appropriate administrative, technical and physical protection to protect information.
5. Rights of the person concerned. At any time you can exercise the rights granted by the art. 15 GDPR, where applicable, and specifically the rights to: a) access to personal data (including the origin of personal data, purposes and methods of processing, logic applied in case of processing with electronic means, identification details of the owner, managers responsible or the categories of subjects to whom personal data may be communicated or who may become aware of it); b) obtain updating, rectification or cancellation of the same or limitation of processing; c) oppose the treatment; d) data portability; e) withdraw consent; f) propose a complaint to the supervisory authority (Garante Privacy).

RIGHT OF CANCELLATION
If for any reason you are not satisfied with the purchase made, you have the right to cancel the agreed contract without any penalty and without specifying the reason, within 14 days of the date of receipt of the product. The withdrawal must be expressed according to the terms above mentioned, presenting any explicit statement of your decision to withdraw from the contract, by e-mail or fax, specifying all the details of the sale:  sender, invoice number, order number. Furthermore within the same term of 14 days you will have to return to the sender-supplier all the goods purchased, intact, packaged in their original packaging, without any lack. These could be sent to Grafiche Tassotti srl - Via San Lazzaro F., 103 - 36061 Bassano del Grappa (VI) Italy.
The cost of returning the goods and the means of delivery will be the responsibility of the buyer and will not be reimbursed by GRAFICHE TASSOTTI s.r.l. in the case of the goods being lost or damaged.
When the goods have been received, GRAFICHE TASSOTTI s.r.l. will issue a credit note for the entire sum paid out by you. Such credit note will then be reimbursed after 14 days if you decide not to purchase other goods. The refund will be made using the same method of payment used for the initial transaction.
The right to cancel the contract in the above terms may not be exercised if you purchased the goods for uses relating to your professional work or as a commercial retailer and with the issue of an invoice by the supplier. In this case your purchase is regarded as being sold according to ‘retailer’ methods separately and directly agreed with GRAFICHE TASSOTTI s.r.l..
The right to cancel is also excluded in the case of purchasing personalised or specially packaged goods or those that, by their nature, cannot be returned or risk deterioration or rapid alteration.

ODR - Online Dispute Resolution
If you've had a problem with something you've bought online, you can use this site Online Dispute Resolution to try to reach an out-of-court settlement. You can only use it if you live in the EU.

GUARANTEE FOR THE PRODUCTS
The consumer has the right to the legal conformity guarantee established by the Consumer Code (art. 128 and following of legislative decree n. 206/2005) for any non-conformities that occur within a period of two years from the delivery of the good. The consumer is required to report the non-conformities within two months of discovering them using the contact details provided herein. The non-conformities that are found within the first six months shall be considered to have existed at the time of the delivery.
In the event of defects of conformity, the consumer has the right to ask for the product that was purchased to be repaired or replaced free of charge, unless the specific remedy chosen by the consumer is objectively impossible to satisfy or is excessively onerous for Grafiche Tassotti, in accordance with art. 130, paragraph 4 of the Consumer Code; where applicable the consumer may request a reduction in price or terminate the contract.

MEANS OF ARCHIVING THE CONTRACT
In accordance with art. 12 of legislative decree n. 70/2003, GRAFICHE TASSOTTI srl hereby informs its customers that every order that is sent shall be archived in a digital format in a confidential and secure manner. Customers may at all times check and download their online orders and the sales conditions by accessing the area "My account".

The present General Conditions and the contracts are governed by Italian law. The Court of Vicenza will have exclusive jurisdiction, without prejudice to the different territorial jurisdiction established by the specific regulations of the Consumer Code in the event of disputes with consumers; in said cases the jurisdiction shall pass to the court of the town or city where the consumer in question is resident.
